Mutation challenged: correcting the revenue record through the civil court

A mutation (intiqal) entered in the revenue record is a fiscal entry — it creates a presumption of truth, not title. When a mutation is procured by fraud, without notice to the real heirs, or on a forged deed, the remedy is a suit for declaration before the civil court.

The suit's shape

Prayer: declaration that mutation No. __ is the product of fraud/misrepresentation and void, with consequential direction to correct the revenue record (jamabandi). Annex the impugned mutation, the jamabandi, and the deed relied upon. Limitation: 6 years from knowledge of the entry under the Limitation Act.

Litigation notes

Exhaust revenue remedies first if you want the record corrected administratively — but fraud mutations belong in the civil court. Where the mutation rests on an oral gift or family settlement, expect a full trial on possession and consideration. Interim stay against further alienation is standard alongside the plaint.
