Succession certificate: procedure, timeline and the objections that stall it

A succession certificate under the Succession Act 1925 vests in the holder authority over the deceased's movable assets — bank balances, securities, debts — and gives paying parties protection. It does not decide title to immovable property.

The uncontested path

Petition the District Judge (or the court the Act designates) stating death date, residence, right in which the petitioner claims, absence of impediments, debts/securities sought, and the other heirs. Service by citation on heirs and publication is mandatory; NADRA biometric verification has streamlined heir confirmation considerably.

Contested cases

Where heirs dispute entitlement — a second marriage, an excluded heir, a will — the court converts the petition into contested proceedings and decides shares under the applicable law of succession. Bonds/security may be required before the certificate issues.

For succession disputes straddling movable and immovable property, combine the certificate with a partition/declaration suit strategy — search SanadAI for the verified authorities.
