When to file a writ petition (Art. 199): the maintainability checklist
Article 199 of the Constitution empowers the High Court to issue writs against any authority or person performing functions in connection with the affairs of the Federation, Province or local authority — and to enforce fundamental rights where conferred by Chapter 1 of Part II.
Maintainability hurdles
The petitioner must be an 'aggrieved person' — a real, not academic, grievance. The writ will not lie where an adequate alternate remedy exists (statutory appeal, revision, representation), or against purely private disputes. Service matters and disputed factual inquiries are generally outside writ jurisdiction.
When it is the right door
Illegal detention (habeas), acting without jurisdiction, mala fide exercise of power, violation of a statutory or constitutional right, and failure of an authority to perform a legal duty — these are the writ's home ground. Attach the impugned order/action and demonstrate why the alternate remedy is not adequate, or does not exist.
Interim relief under O.XXXIX travels with the writ; a writ admitted without interim protection can become infructuous — pray for it expressly.
